Legal Question in Credit and Debt Law in Massachusetts

Having a lien put on your home

If I'm in a payment plan with a creditor can they actually put a lien on my house. I was working with a credit debt place to help me and never knew that they didn't come up with a payment plan. Never even tried to set up anything and because they didn't the creditor hired a lawyer and now there is a lien I was willing to pay monthly but never got the chance now I don't know what to do .

Re: Having a lien put on your home

Generally speaking, pursuant to Massachusetts Law, no creditor can place a lien on your property without prior notice and an opportunity to be heard, subject to certain exigent circumstances. Further, there are various methods available to "dissolve" the lien. The specifics of this area of law are quite complex. Please contact my office if you would like a free consult regarding the facts of your situation.
