You need to file a law suit, and seek permission from the court to file a lien.

You must file a law suit and obtain an attachment or a judgment which you can then levy against the property unless you have a signed contract which you can file as a notice of contract. If you need assistance retain an attorney. Good Luck!

A creditor can place a judgment lien on a debtor's property by following the procedure articulated under Massachusetts Rules of Civil Procedure 4.1, subject of course to various protections, including, but not limited to, Massachusetts General Laws 188, Sec 1 et seq. (Declaration of Homestead) and Massachusetts General Laws 235, Sec. 34.:))
