someone has used my name to make a credit card
Somebody got a hold of my fathers name and opened up a cell phone acount under that name and charged up a bill. They knew it wasnt him because the social sequrity numbers did not match. Then my brothers name was taken and opened up a credit card with it and charged up a bill and the social sequrity numbers did not match again. The bill colectors are rude and have been hounding my brother and my mother to get there money. Both times the address the person had was the same and we think we know this person. The bill colectors tell us not to go to the house and confront the person that they will take care of it but they havent takein care of it. How can we stop this person and make sure they dont do it again to another family member?

YOUR NAME (in the Title)? Or your Dad's and brother's? Do you only care if you're the next victim? Is there some reason to think he'd pick on someone else in your family? What makes you think you know who it is, or, rather, what makes you think your suspect is the culprit?
Go to the police station and file a report; I THINK they should be interested, should go investigate, and possibly "interview" (and thus intimidate) your suspect, if you have good enough evidence to suggest him. With reasons to suspect him, they can get subpoenas and find out more, e.g., where the money went. If you have or they can get enough evidence, they should prosecute him as well.

There are claims under the Fair Debt Collection Practices Act, a federal law, that I would make against the bill collectors who hounded your family if they knew better, but your family members would have to contact me directly. It may be better to have leverage to get them to act against the actual culprit instead of pursuing you. -- Stuart Williams, (617) 527-0050.
