Legal Question in Credit and Debt Law in Massachusetts

Hello -

I am in Massachusetts and in a same sex marriage. If something happens to one of us, are we liable for each others debts from a location that does not recognize us as a married couple?

Generally speaking, the debts of a deceased person do not become the obligation of his surviving friends or family. The deceased individual's estate, however, will be responsible for paying all the just debts of the deceased. That means that before any distributions can be made (to you, or his other beneficiaries) debts would need to be paid or negotiated. The answer to your question will depend on the type and nature of the debt in question, so feel free to contact my office if you would like more specific information.
