Legal Question in Credit and Debt Law in Massachusetts

paying off a lien

hi, i need help,

i recently sold my home, which had a $1700 lien on it from a credit card company,, my attorney witheld double the amount from the sale of the house $3400 in order to pay the lien and any other fees accrued by credit card co..

it has been over two months and still the lien has not been paid and the attorney still has my money,, i thought he was required to pay this immediately, is there some law he is violating, meanwhile there is a judgement out against my husband and the attorney still has $3400 in cash, we have called numerous times to the attorney and he claims that the attorney from the credit card company has not returned his calls with a final lien amount?? i find it hard to believe that the attorney would not return a call about collecting money, please advise, can i demand the $3400 back from my attorney and just get the information and call myself?? also, on my list of fees, my attorney charged me $250 for correspondence to this lien...

thanks for your help,,

sincerely,,,

Re: paying off a lien

An attorney owes you a duty to respond in a reasonable amount of time, and to try to settle this situation within a reasonable amount of time, or to advise you about the delays, and the reasons for these. If the attorney is not returning the calls, I suggest that you send him a letter, even a certified letter requesting answers to your questions. I belive this is a good first step. If you have any other questions, please contact me.
