Legal Question in Credit and Debt Law in Massachusetts
payment of debt
My husband purchased a washing machine in June and in August he passed away. The probate dept of Sears called me and wants full payment. He agreed to pay within a year. Do I have to pay this debt?

I am sorry for your loss. Are you the executor/administrator of your husband's estate?
The demand for payment of a debt should be made against to the executor, who can then decide whether the debt is valid.
You should probably hire an attorney to help you in the settlement of your husband's estate. They will be in a better position to evaluate the validity of your husband's debts.
Re: payment of debt
Generally speaking,a married woman shall not be liable for her husbands debts, nor shall her property be liable to be taken on an execution against him. But a married woman shall be liable jointly with her husband for debts due, to the amount of one hundred dollars in each case, for necessaries furnished with her knowledge or consent to herself or her family, if she has property to the amount of two thousand dollars or more.
