payment plan
I had received a letter from an attorney attempting to collect on a credit card debt they say i owe of $7156 and some change. I sent them a check for $ 100.00 and waited to see if they would accept it and cash it and they did. They applied it to the balance and sent me a letter stating that they had received the payment,but since an actual payment plan hadn't been established, that I needed to call them and set one up. I called yesterday 6/12/06 and talked to some lady that told me that since the amount was so high that they would need a substantial amount down to make a payment plan....my ? is since they accepted my $100 payment, then why did I get a letter stating they they were going to garnish my wages? As far as I'm concerned, when they accepted my $100 payment, they established one.

Unfortunately in your situation, paying part of a debt does not create a payment plan that the other side is bound to. If this is your only debt, it may be something you can work your way out from under; if this is the tip of the iceberg, you may wish to speak with an attorney about your options.
