Legal Question in Credit and Debt Law in Massachusetts

Who pays credit card bill

My future husband co-signed a credit card for his then college daughter 12 years ago. She has not taken his name off the credit card although she has been ask to several times. Now 12 years later she is not going to pay her $5000 bill. Her father is divorced and is un-employeed and has no money to pay the bill.

We jointly purchased a house a year ago when he was employeed but I paid the down payment and have been paying the monthly payments. He has not contribute to payment of the house. Can the credit card company come after us? Can the credit card company come after me?

I feel like I am being used and I don't know what to do to protect myself from his families problems?

What advise would you give me? Please be honest and let me know what my options are at this point. I don't have money to pay for his daughters bills?

Thank you,

Re: Who pays credit card bill

Your options depend on:

1. Where do you and your husband live.

2. Do you have a homestead exemption

3. What does the credit card agreement that he signed say.

4. What actions he has taken to remove his liability.

5. Whether any of the parties have filed bankruptcy.

6. What assets the parties have, and whether they are held individually or jointly.

Gather up this information, as best you can, and contact an attorney in your area. The money you spend to speak with an attorney, and to protect your interests, will be worth you sleeping soundly at night. If you are in Southeast Mass, call me at (508) 822-7777.
