Rental car payment disagreement after accident

I got into a car accident recently and the other driver's insurance company claimed 100% liability for cause. I needed a rental car so I rented a Volvo wagon (I drive a Volvo convertible). After being in the rental for about 1 month, I was finally notified that the other parties insurance wasn't going to pay the total bill for the rental because they don't feel that the 2 cars are comparable. I've talked to everyone at this insurance company and no one will budge as far as this decision. If I want to sue for the remainder of the bill, which I have not paid yet, do I sue the insurance company or the driver? I've basically threatened with court to no avail.

As a strategic matter, if you are really going to engage in litigation, it is generally best to sue everybody that could possibly be liable, using every reasonable legal theory, and let the legal process sort it out. Threats are no good unless you are prepared to carry them out. If you are, talk with a lawyer about the specifics of your situation to see what would probably be most efficient and inexpensive for your situation. Good luck!
