Legal Question in Credit and Debt Law in Massachusetts

Request for Documentation, Statute of Limitations for Credit Card Debt

Hello, I have a Summons that includes a Complaint for what may or may not be an old credit card debt. Via telephone, a Representative of the Attoney's office told me that this account was opened in 1999 and closed in 2000. I would like to request in writing a full detail of this account. In addition to a copy of any credit agreement, statements from account opening to account closing, what can I request in writing. Also, what other information should I be requesting? What is the statute of limitations on such a matter? Are they required by law to provide written answers to my questions? Your assistance is appreciated. Thank You.

Re: Request for Documentation, Statute of Limitations for Credit Card Debt

Hello -

Thanks for writing. Typically, after filing an Answer (to the Complaint you received) there will be "discovery" between the parties. "Discovery" is the exchanging of information, documents and evidence between the parties. These credit account statements will be provided to you upon your request.

If you're interested in being represented by an attorney in this matter, feel free to give me a call at (603) 978-0421. My name is Len Foy, I'm an attorney in New Hampshire and Massachusetts. We may have an opportunity to negotiate and settle with the credit card company for a reduced amount, or, if the charges are not yours, we can contest liability and defend the case.

I look forward to hearing from you - good luck.

Regards -

Len Foy
