Legal Question in Credit and Debt Law in Massachusetts
I have a small claims judgment against me for $320, my check bounced to my oil company. A constable showed up to my house and told me that I had to hand over the keys to my car, they had an order allowing them to seize my car for payment. I was not home so he informed me that if I did not have $900 for him (this includes his fees) or my keys, I would be arrested. I went to the oil company today with an invoice they sent me on 10/1/09 for the amount of $320, I tried to pay them in cash but they refused my payment and said I now had to go through the constable. I have no way of coming up with that extra money, do I have any options? Can I be arrested for not giving him my car keys? Can he forcefully remove my vehicle from my garage? I have $400 I can give him, but he wants more. He will be coming to my home tomorrow and I'm really scared.
