I signed as a co-signer for a vehicle purchased by my ex-boyfriend in the state of florida in 2002 the vehicle was later turned in as a voluntary repo in late 2003 and the vehicle was sold at auction forwhat seems to be an unreasonable amount of money. it was a 2000 ford explorer sport with only 33,000 miles sold to us for 14,000 and sold at auction for maybe 5000 because i am now being sent a collection letter for an amount of 9697, and am being threatened with being sued and having my wages garnished. I don't feel that I should have any responsibilty to this debt nor that it is in any way valid being that the vehicle was sold and that i never received any written document indicating where or when the truck would be sold. and i now live in massachusetts. is california recovery bureau even licensed to collect in my state?

As I am not licensed to practice within the State of Florida, I cannot comment on the law governing repossessions within that state. There are, however, statutes within the Commonwealth of Massachusetts which govern and protect the rights of consumers with respect to retail installment sales contracts ( see Massachusetts General Laws Chapter 255B). Your debt goes beyond your relationship to your ex. It seems that you may have been a guarantor??

Your rights and obligation depend on the wording of the contract, and the state in which the contract was signed.

If you believe that the collection or recovery company is acting outside of the bounds of Massachusetts regulations, contact the office of the attorney general, consumer division.
