Legal Question in Credit and Debt Law in Massachusetts

Sued over credit card debt

I am being sued for a credit card debt for $5,000. The last transaction on my credit report of this credit card was 5/2001. I was served 8/07. Suit filed 7/07. I live in MA. Is the statute of limitations over? I can't afford an attorney. I must answer this summons in 20 days. Is there a form/template I can use to answer this? I cannot pay off this debt, either. I could work out monthly payments but wonder if the debt is valid.

Re: Sued over credit card debt

John is correct.

There is no simple form to defend against a law suit, and you may have to spend money in order to relieve yourself of this debt.

Please let me know if I can be of any assistance. I am located in Quincy, Massachusetts.

Re: Sued over credit card debt

The statute of limitations on a contract governed by Massachusetts law is 6 years from the date of breach. It appears the debt may be outside the statute of limitations period and, therefore, time barred, which means any action to collect such debt would be unenforceable under Massachusetts law. I would suggest contacting my office for a free consult relative to the facts of your specific situation.
