Legal Question in Credit and Debt Law in Massachusetts

Being Summoned- Do I need to reply?

A creditor has forwarded my account ($6K now) to a collection agency which gave up and then forwarded it to a Law firm (total time elapsed: 4 years). Apparently, they filed a lawsuit last April but I didn't get anything from the court. They then filed a motion to extend the time to service until March. I just received a ''Summon'' from them. DO I need to reply and counterclaim. If I do not reply, is that a Judgement by default or would there still be a court date. etc... Any links on how to fight this thing (out of job, etc..). Many thanks to all who answer.

You should answer IF you don't want to lose. If you don't answer, you automatically lose; there would be no court date. When you lose, the law firm could garnish your wages or engage in other types of collection activity. If you have a defense to the claim, you MUST answer and tell the court. Good luck!
