Legal Question in Credit and Debt Law in Massachusetts

Taking rent from income of a non-profit

A ticket agency associated with the building we rent as a theater is planning to take rent money directly from ticket sales of our performances. We do not see any income until the ticket sales equal the amount of rent due. This is a new procedure which was just instituted. This was not the case last year. We have not been delinquent with our rent payments in the past. Is this legal?

Read your lease to see if you authorized this without realizing it.

Have you inquired with the lessor as to why they're taking this action, I agree that you should review your lease - if you're unhappy about this and the landlord won't budge, give our office a call at (603) 434-3437.

I practice in both Massachusetts and New Hampshire.

Regards and Good Luck -
