Legal Question in Credit and Debt Law in Massachusetts

Voiding a judgement

When filing a motion to vacate a void judgement/judgement can you site cases from other states and or federal courts, or do all cases stated have to be from the same state?

Re: Voiding a judgement

Assuming that you are a consumer attempting to vacate a default judgment, you should go to your local courthouse and request a motion to remove default judgment.

You will need to provide reasons why the default judgment should be removed. Assuming the default judgment was granted fairly recently, you should not have too much difficulty here.

Once you have removed the default judgment, you must immediately answer the original complaint and probably request some discovery of the debt collector.

Please do not hesitate to contact me should you require any further assistance.

There is no rule under Massachusetts Procedure which prohibits a moving party from citing cases in other jurisdictions.;)
