widower

my mother passed away 5 years ago and the credit companies are still sending bills even after they get sent back to sender written deceased on the front. Is my father responsible for the payment of these bills?

I am sorry for your loss of your Mother.

Your father should retain an attorney to be certain that neither he nor your Mother's estate remain liable to these creditors. Once that is determined, a letter from an attorney may resolve the matter. Good Luck!

You should contact a lawyer immediately.

Assuming that your father was not an authorized user on the account, and that purchases were not made on his behalf for 'necessaries' like food, shelter and clothing, he is not responsible. As far as collecting from your mother's estate, they have absolutely no legal right at this point to do so.

It may simply take a letter from an attorney to make the collection efforts stop. Don't hesitate to get in touch with my office if you would like to discuss this matter further.
