accusation of theft in a retail store

a relative of mine was caught and accused of stealing $329 worth of goods in a retail store worse case scenario what can happen? this person had no prior run ins with the law and is 67 years of age. clean criminal record first offense.

Larceny Over $250 carries the potential for 2 1/2 years in the House of Correction. However, realisticly, a 67 year old person who was caught red handed (the product was probably returned unopened) should get either pre-trial probation or at the worst case, CWOF (Continued Without Finding), which means that the case should be continued, either before or after admission of guilt (respective to the two options above) and then dismissed after 3 to 6 months. At least thats what I would expect if I were representing this client. Certainly NO CONVICTION! Your relative could be charged with larceny over $250 for a potential jail sentence is possible. tehy should retain an attorney and speak only with that attorney about their representation.

He can be charged with larceny over 250. He is unlikely to go to jail. He should see if he can cut a deal with the store owner through an intermediary.
