Legal Question in Criminal Law in Massachusetts
I got my apartment searched without a warrant by two cops, one undercover in a cop car and the other in full uniform but in an undercover truck that I had seen in near my apt before. They knocked saying it was a noise complaint and took advantage of my moment of confusion and stepped in. They found under an ounce of my personal weed (ive been trying to get a medical card), a small scale i use to ration my supply, $3,000 in 5s and 10s i had stashed for rent, empty bags, and rubberbands. Some of the items were props from a music video my friend and I were shooting as well. Needless to say it was all obtained w/o a warrant and nothing was in plain sight. They are charging me with distribution and the police reports are littered with lies and them making up things that I said to them. What should I do?
preparing my defense by stating how they violated my rights, lied, the fact i use canibus medicinally, and the fact we had the video shoot. Also it was on the day i was evicted out of my apartment which is why I believe my landlord set me up because I had complained about the apartment conditions.

Hi. It sounds like you can attack the unlawful search. It also sounds like they don't have the evidence to prove intent to distribute a Class D substance. If you want to discuss, you can give us a call.
