Legal Question in Criminal Law in Massachusetts
applying for gun permit
In 1989, I was convicted of (felony) assault in CT. I was given 2 years accelerated probation and told all goes well, case would be dismissed. Well all went well and never heard from state of CT again. At the time, I had a license to carry a firearm in CT and was never asked for it and I had firearms, and the state knew it, and was never asked for them. Anyway, I now live in MA, and I am applying for an FID card, possibly a LTC. When they do an FBI check, what will they find? An arrest? A conviction? That the case was dismissed? Is there any way I can (or a lawyer) can a run that same check on me to see what comes up?
If asked if I have ever been a defendent in court of law, guess I have to say yes. If asked if I have ever been convicted of a felony, is it OK to say NO and it was dismissed?

I can not answer to laws of CT. However, in MA, if you are given a CWOF (Continued Without a Finding) that is eventualy dismissed, you can truthfully state that you have never been convicted of a crime. You are entitled to a copy of your CORI (Criminal History) upon request from the Bureau of Probation. I know that is MA it is in Boston. I do not know where the CT equivalent is but you can find out by asking the probation department of the court in which you received the CWOF originally.

YOU NEED TO SIT DOWN WITH A LAWYER, WHO CAN WITH YOUR PERMISSION RUN A CORI CHECK AND GO FROM THERE. THAT WILL TELL YOU THE STATUS OF THE CT MATTER.
