Legal Question in Criminal Law in Massachusetts
I had an argument with my son who is on drugs. He grabbed me by the shoulder and threatened me so I called the police and they arrested him for assault and battery. They sent him to a rehab hospital and there is a hearing on Jan 4. I told the D.A. office I do not want to press charges since he had a prior offense, and he needs rehab and a half-way house, not jail. The victim's advocate told me I should go to the hearing even if I do not want to press charges. Will that be worse or better for him if I go to the hearing?

It's hard to know the answer to this question, because I do not know what other evidence might be available. Your best bet is to reach out to your son's attorney, and do what he or she recommends.
