Legal Question in Criminal Law in Massachusetts
Was arrested
I'm 17 and I was arrested the other night for possession of alcohol even though I had no alcohol, it was just an empty box in my friends trunk. However I didn't know what I was being charged for until the next day in court. The officer arrested me and put me into a holding cell without reading me my rights or telling me why I was being arrested even after I specifically asked him three different times. They also refused to let my father see me or bail me out. Was all of that legal?

It was very odd for you not to be bailed out for a minor charge. Without knowing more I cant say what the police did was illegal. However, the arrest may have been-depending on the circumstances-hire an attorney or at least speak with one.

Retain an attorney and confide only in that attorney. Good Luck!

The rights are not required unless you are being interrogated. Depending on the time of arrest, an assistant clerk should have evaluated you for bail. The refusal to let your father bail you is odd. Even assuming all of this was done, it is not clear that this conduct arose to illegality.

The real issue that you need to focus on is the charge against you. To keep your record clean you should hire a criminal defense attorney. Its easy for a young man such as yourself to think that it is no big deal and because you feel that you were right that you don't need a lawyer and it will all work out for you. The harsh reality is that without a good lawyer, you may well have an entry in your criminal history that will effect your ability to get financial aid for school and most likely, a job later on in life. You only have one chance to handle this right. Let someone who knows what they are talking about (a LAWYER) advise you. Any advice that you get from a person without a law degree will be worth exactly what you pay for it, nothing.
