Legal Question in Criminal Law in Massachusetts
I was arrested on a 25 year old warrant today during a traffic stop in massachusetts for larceny over 250 in massachestes (in 1985), I have been given a bond and told to report to the court that issued the warrant in the morning. I intend to plea not guilty and ask for a continuance to get legal representation, is this the correct way of approaching this?

If you qualify, the court will provide a lawyer for you tomorrow. If you do not qualify, then your plan is correct. You might see if you can resolve the issue tomorrow, however, with or without a lawyer You might ask if that is possible so you don't need to be bothered with this any further. What court are you in? If you want me to appear with you tomorrow, contact me directly.
No matter what the circumstance, a 25 year old case will be very difficult for the Commonwealth to prove. You may be able to handle it yourself on Monday, but if the DA's office intends to pursue the matter you should consult an attorney.
The odds of finding the old paper work is remote, and this needs to be used to your advantage. This could also be dismissed on costs on your surrender. Do not take a chance and go to court with an attorney, and if you have any questions, contact me.
