Asault and Battery In Mass.
I have been charged with A&B and have no priors. I was actually the one assaulted and have the pics to prove it, but because the man has no morals, he filed the charges because I left the state as my work for him as a subcontractor was over. Now because he filed charges I have to spend money I do not at all have to go back out there to fight it.
I need help.
I am also thinking if it is possible to sue him personaly because of the pain he caused from the assault. I live in North Carolina is why I am saying I do not have the money for travel since it would cost around $500 for the trip and I have been out of work since middle of Jan, but just recently got employment.
I have pics of my lip after the altercation and my truck window where he pounded on it and left his blood, and the officer also witness the lip and window at the scene. I am to appear in Mass. on the 17th of March, so any help would be appreciated, as I am sure I will end up calling someone out there to help me with this as I do want to discuss the possibility of suing him for what he has done against my family and I.

YOU are charged with Assault & Battery and although there is no reason not to believe your claims about what the other person did, you need to focus on your own defense at this point because if you are found guilty, you obviously will never have any chance of suing anyone for anything. Pictures of your injuries do not exhonorate you. They may be helpful evidence for your defense, which I presume to be self-defense, but a picture does not indicate who hit whom first. That is, "he said, she said" type of testimony, which the investigating police obviously already heard and found you to be the aggressor. I would be happy to defend you and your defense may very well be to mount an offense, but I strongly advise you to hire a good criminal defense attorney that you trust and then to take his or her advice. I have handled 100s if not 1000s of these types of cases and I can tell you that what you need to focus on is your own defense.

I agree with Attorney Casale. You need to focus on your defense of the criminal matter. Unfortunately for you, you will have to appear in court in Massachusetts to do so. Since your court date is quickly approaching, I advise you to contact a Massachusetts attorney right away.
