Assault & Battery Charge
I was charged with assault & battery.. first time..what is the penalty if found guilty... I was not arrested but sent a summons.. it was a fist fight between me and a kid that do not get along..he had minor injuries, i.e., bloody nose, broken blood vessel ..that's it. DA is saying they can put me away for 10 years plus a fine of $5,000..is that possible the first time around?

The penalty for simple assault and battery is anywhere from a fine(not more than $1,000.00)to probation to incarceration for up to 2 1/2 years. It all depends on your criminal record and the circumstances surrounding the incident. You may also have affirmatvie defenses. I suggest you contact a lawyer and not speak with the DA.
