Assault in MA
My son is being arraigned for this charge in MA next week. He has never been in trouble, has a strong community service record and has been in anger management and battering counseling for approx. 3 months. One session has been completed. The DA seems anxious to work with him, however the victim wants the issue pursued to the max. What is the likelyhood of him having to leave college and see the inside of jail/prison for this incident.

It depends on what he is charged with and whether or not the alleged victim was injured. It is in your son's best interest to hire him an attorney. If he has no record (and this is not knowing any facts of the case) it is not probable that he will go to jail, unless there are serious injuries. It depends where he is in Massachusetts, but if you need a referral for a criminal defense attorney in the western part of the state, I would be happy to give you some names of good ones. If it is in the eastern part of the state I would be happy to discuss representation.

I have to ask why he's in batterer counseling and anger management if he's never been in trouble? Usually these programs are court-ordered as a result of a domestic violence conviction. If he truly has no record, jail is unlikely. Which court is hearing the case?
