Legal Question in Criminal Law in Massachusetts

Assualt & Battery

My Boyfriend and I got into a heated arguement which resulted in me slapping him and him forcefully pushing me out of his house. I was angry so I filed a police report against him. However I did not tell the police that I slapped him first. I have been trying to get these charges dropped but I know that is impossible to do. I do not want to see him spend time in jail for something that was not as serious as i made it out to be. Also they have pictures of bruises on my arm, however they were the result of me trying to fight my way out of his grip when he was leading me out of his house. They were not the result of him assaulting me in anyway. I have a disease also that makes me bruise easily which made the bruise look worse than it actually was. Is there anything I can do in this case?

Your situation is not uncommon. What you need to do in this case is hire a licensed attorney.

In general, an attorney may be able to negotiate with the prosecutor to achieve a desirable result.

In some cases, an "Accord and Satisfaction" agreement can result in the case being dismissed by the Judge. This is an agreement that states the victim is satisfied by an apology or otherwise, does not wish to have the state pursue the charges, and requesting that it would be in the interest of justice for the case to be dismissed.

Criminal charges are a serious matter - the best advice is to hire an attorney who can discuss all your options.

One additional point I would discuss with your attorney is your right not to testify against your spouse.

Depending on whether or not there were witnesses to the event, the evidence against you may also warrant a dismissal.

Feel free to contact this office to discuss further.

You have a number of options. If he was arrested, speak to his attorney about claiming your 5th amendment right against self incrimination, and you could also sign what is called an accord and satisfaction.

If you need assistance contact me.

There is a solution to this.
