Legal Question in Criminal Law in Massachusetts
is this assualt?
i work security and one day at work someone came up to me and said to me to arrest his friend in a kidding way. i said what would i arrest him for. his friend then said he aint going to arrest no one and then started asking me questions asking if im a cool guy right all sarcastically and wanted to shake my hand and i said i don't shake hands. i said to him that i do not like to shack hands then he grabbed my badge and said is this thing real. Could this be considered assault do to the fact it was unwanted touching by another? note this person has been causing all sorts of problems on the property with his friends and is suspected of breaking into cars.

I agree with Attorney Lebensbaum. While technically it would be considered a battery, I doubt that you would get much relief, if any, from the courts, based on this set of facts.

yes. You are talking about battery, the unconsented none-accidental touching.
Having said this, focusing on the specific incident, it seems like a joke that may have been misunderstood and got out of hand.
I am not you, but I would just move on.
