Simple Assault & Battery max penalty is 2.5 years in the HOC therefore it is NOT a felony. If it is aggravated or on an elderly person or any other variation that allows for state time versus house of correction time, it is considered a felony

No. It is a misdemeanor. But you should retain an attorney to defend you as there are options to pleading guilty.
