attempt to distribute

my boyfriend was arrested with a half ounce of weed ($50.00 worth)and also in another bag he had five dollars worth, he is being charged with attempt to distribute. the only reason he had the five dollars worth is because it was the last of is weed. they also seized $275.00. what do you think could happen

It is common to over charge. This is only the beginning, and it is used by the DA as leverage to force a plea. It is still the government's burden to prove that the drugs were seized legally, and that there was intent to distribute. A first offense marijuana charge usually results in probation. It may have effect on the person's rights in other areas, such as student loans. I hope that your bofriend has an attorney, or gets an attorney who can assist him in analyzing the situation, and providing him with an approach and the options in his particular case. There are many factors that decide what could happen with a case--examples are: the individuals past criminal history, the actual facts of the case, the town/city where it took place, the court where it is being the prosecuted.
