Legal Question in Criminal Law in Massachusetts
Buying and Selling Gift Card
I purchased gift cards from
s.one and sold them on
ebay. I found him via
craigslist.
I asked him at least 3-4
times that question; Are these gift
cards obtained legally and safe, I
do not want to be in trouble. Every
time he gave me same answer.
These are absolutely obtained
legally and safety. He said I had a
job, and I had a huge inventory,
but becase of the financial crisis my
works went bad so I had to return
some of my items purchased before
so these gift cards are coming from
those transaction. And also
everytime he came to store with me
to purchase the balances of gift
cards. I trusted him because
of his behaviors and explanations.
He sold six or seven gift card to me,
total value was around $ 3500.
One day he wanted to sell another
card to me, and we meet him. I
brought some money with
me to buy gift card.
Suddenly he attacked me and tried
to steal my money. I barely save
my life and called police directly. I
explained everything to police.
Now my concern is that those gift
cards he sold me were obtained
legally or illegally, because I don't
have any idea regarding with those
cards. And if those cards were
obtained illegally, what should I
do?

Re: Buying and Selling Gift Card
Retain an attorney and confide only in that attorney in the event that the police find the cards were stolen and decide to charge you with knowingly receiving stolen property. Good Luck!
Re: Buying and Selling Gift Card
The police may very well assume that you were complicit in the venture and the cards were probably illegal. You should hire a good attorney now and follow theie advice. I can assure you that the police will be calling you. You should hire a lawyer now so that he is on board when the police contact you and he can advise you of what NOT TO SAY. In the meantime, say nothing about this to anyone. Hire a good criminal defense lawyer and let him advise you. Get someone good who you feel confident in.
