Re: cell phone message

Depending on the type of message (voice/text), the words used, etc., the Commonwealth can prosecute. The issue wiil then be whether this prosecution will be successful. There will be foundation issues, identification issues, privacy issues, etc. Your son should discuss this case with a lawyer right away. If you have specific questions, please feel free to call me.

Your son should retain an attorney immediately and confide ONLY in that attorney.

Re: cell phone message

Your son certainly needs a criminal lawyer. Obviously there was enough on the tape to charge him. It doesn't necessarily mean that it is enough to convict him, but until we listen to it and hear what it says, there is nothing more to do but hire an attorney and try to beat or minimize the charge.
