Legal Question in Criminal Law in Massachusetts

Changing plea

I was accused of leaving the scene of an accident. I did leave the scene after someone hit my car (I was on a throughfare and the person who hit me was exiting a parking lot.) I left the scene because the other driver was threatening me and I called the police from my car to report. The officer who arrived on the scene after I left cited me for leaving the scene . . . . After 5 appearances in court and harassment by the DA, I agreed to pay a fine and waive a jury trial. Now I find I can't pay the fine. I am on a fixed income and just can't find the money. Do I have a right to request the jury trial at this time, after I accepted the bargain that charges would be dismissed if I paid the fine?

I am convinced that a jury could not find me guilty when the facts are known.

Re: Changing plea

Your action requires amotion to withdraw the plea with an affidavit stating ONLY why you pled, NOT ABOUT THE FACTS OF THE CASE.

The motion must be schduled with the court, with a copy to the District Attorney.

It is a long short. Good luck.
