Chapter 90, Section 24

My brother is in the hospital following an accident that involved only him. In the mail, he received a citation for a criminal violation citing Chapter 90, Section 24 (as well as a Ch. 90, Section 17). Does he have to do anything? And what does it mean?

What it means is he is being charged with Speeding and Operating Under the Influence of Alcohol/Drugs. He should make a copy of the citation and contact a lawyer immediately. Your brother should retain an attorney and confide only in that attorney to defend him on these motor vehicle charges regarding which he may be able to claim a right to a clerk-magistrate's hearing challenging the probable cause to issue the complaints, if he acts within the time given on the back of the citation or such extention of that time as may be granted, if he is incapacitated by his injuries. The Chapter 90, Section 17 citation is a speeding ticket. The Chapter 90, Section 24 citation could be one of a couple of different things. It could be a citation for negligent operation of a motor vehicle, or it could be operation under the influence of drugs and/or alcohol. Without knowing the exact circumstances of what happened, it's difficult to know whether the government has a strong case, or whether they are simply guessing and hoping that the charges stick. In response to your first question, however, your brother will have to appear in court to take care of this. Attorney Dwyer's advice is good advice, particularly if there were no eyewitnesses to the accident or to establish that your brother was the person driving the car at the time of the accident.
