Legal Question in Criminal Law in Massachusetts
Chapter 90, Section 24 - Negligent Operation
Thanks to all that responded to my last question. My new question is this: A citation was sent in the mail indicating Ch. 90, Section 24 -- negligent operation. Does this mean that OUI is not also alleged/charged? My brother crashed his car early a.m. He was cited for speeding but he hurt no one but himself and his car. He says he fell asleep. He is in the hospital with a broken neck so details are not as forthcoming as I'd like.

Re: Chapter 90, Section 24 - Negligent Operation
OUI is not charged. A Chapter 90, Section 24 citation could be for either OUI or negligent operation, or both. Apparently, in your brother's case, it is only for negligent operation.
