Technically speaking, you can always ask for a dismissal, but you're going to need more than that to be successful. The most important component of the case against you would be the statements of the victim and the witnesses. Lack of visual evidence of abuse and the victim's failure to go to the hospital, by themselves, don't amount to much in your defense.
