: how do you get charged with statutory rap
Absolutely. The government still needs to prove its case.
You should talk to no one, and certainly not post a detailed description on the internet.
The next person you should and must speak to is an attorney to analyze the case, and discuss your options.
If you seek further information or representation, you can call my office.
If you want to provide me with more essential information about the situation, or contact me, then I can provide me with the necessary details, so that I can evaluate what is going on, and give you my thoughts.
If you would like to consult with me, call me at my office.
Re: how do you get charged with statutory rap
Yes, the 18 year old should retain an attorney and speak to no one other than that attorney as this is a serious crime with serious penalties and is based on the premise that the under age person can not consent.

Re: how do you get charged with statutory rap
Yes. Statutory Rape is based on the legal premise that a person under a certain age CANNOT, AS A MATTER OF LAW consent to sexual intercourse. Walking into court and pleading "consent" in a statutory rape case is the same as pleading "guilty" and will, among other punishments (incarceration), require lifetime registration as a sex offender.
