how do you get charged with statutory rap

can a 18 year old male get charged with statutory rap when the parents and the girl do not wont to press charges.and the girl said it was consensual sex

Yes, the 18 year old should retain an attorney and speak to no one other than that attorney as this is a serious crime with serious penalties and is based on the premise that the under age person can not consent.

Yes. Statutory Rape is based on the legal premise that a person under a certain age CANNOT, AS A MATTER OF LAW consent to sexual intercourse. Walking into court and pleading "consent" in a statutory rape case is the same as pleading "guilty" and will, among other punishments (incarceration), require lifetime registration as a sex offender.
