Legal Question in Criminal Law in Massachusetts
I am being charged with "Threats to commit a crime." My phone was used in a call by an unknown person to me, to an unknown person to me. The police contacted me and said that they are pursuing charges against me because the person that the alleged threats were made to was a police officers daughter. I don't know who the person who was allegedly threatened nor do I know the person who used my phone without my permission while I attended a Christmas party. The police are going after me merely because my phone was used to make the call. I feel like I am being wrongfully charged because the person who was allegedly threatened is a family member of one of the officers at the police department that is pursuing charges against me.

Make sure you have a lawyer with you at each stage of the proceedings. They will need to prove that it was actually YOU who placed the call. Whose phone was used may be a starting point, but it's miles away from actually being convicted of a crime. If you ask a specific question, I may be able to provide more insight.
I would agree-you need to have an attorney as the police are not on your side in this case. You say you have been charged-have they conducted a show cause hearing? What type of threat was made? I assume the po's daughter attends the same school or lives in the same area? it is true that the state needs to prove you were the actual caller-however the charges will most likely proceed and threats to commit a crime are very serious-contact my office for a detailed discussion-774-745-0562
Retain an attorney and confide only in that attorney. Good Luck!
