Legal Question in Criminal Law in Massachusetts
Clarifications on criminal background checks
I searched through the database but didn't quite find what I was looking for.
I've had two run-ins with the authorities. The first was a DUI and the matter was continued without a finding after I met all the requirements.
The second was 'malicious destruction of property valued over $250'. Though I was arrested, I was not involved in the matter and it was eventually dismissed.
My questions are:
Does the cwaf count as a conviction? Would it show up on a background check by a financial institution?
Would the dismissed matter show up in any way, i.e. does a background check only show convictions, or does it show arrests as well?
I ask because I work in high tech and it goes without saying that even an arrest record can be a serious detriment and viewed poorly by prospective employers.
Thanks in advance for your help.

Re: Clarifications on criminal background checks
Yes, especially adult arrests. Each time a criminal complaint is filed, it becomes part of your record, as does the disposition. On the CWOF, you will have this entry usually and a dismissal. Dismissals are entered as such on your record. They are not viewed as convictions.
