Legal Question in Criminal Law in Massachusetts

clearing a record

I was charged with a crime and got continued without a finding 3 years ago. I passed the probation period 2.5years ago and my attorney back then told me I could get my record sealed at some point. Is this true? and if so when can I do this. I have never made any other mistakes and I really want to put this one behind me. I don't want to be worrying that every prosepective employer or apt manager will be seeing something when they do a criminal background check. What exactly will they see?

Re: clearing a record

You may have misinterpreted what your lawyer said. Sealing of records has become extremely difficult in Massachusetts. The CWOF in essence is a form of probation that ends in a dismissal. So if any person asks, it means that for all if not most practical purposes, if this is the only charge, you have no criminal record.

As to further action by you, it would take an investment of funds without a clear assurance of likely success.

Should you have any questions, email or call me.
