Legal Question in Criminal Law in Massachusetts
combining cases
My son had a restraining order back in August. Violated restraining order. Plus a drunk driving charge was included. Went to court 3 wks ago. DA said 120 days in a Alcohol Center-Judge said 6 months 2 yrs probation.
He stole picture frames in November got 6 months suspended sentence with phone probation once a month.
Stole a $10 item in February and that violated all the probations. He was brought to jail at that time. I did not bail him out. He is still there in hopes that all this time will count towards the sentence. This is all 3 different courts including 2 different counties.
What are his options? Will the time run concurrent with each other. The counselor in jail said he should have all the lawyers contact each other. Should he combine them all and take what he gets or go to court for each separate one.
When I type this all out it sounds really bad and quite a mess. Any suggestions?

In each court, there will be a probation revocation hearing. Your son should take the most serious case first and work out a deal, then have the other courts do some concurrent disposition. Without the facts of the RO violation it is hard to say. It sounds like he may do 6 months at a minimum.

I am sorry to confirm what you already know. Your son is in some serious trouble. The situation that you have is really more complex than this type of question/answer is designed to provide. I think you are going to get the same or similar advice from each attorney and that is to hire someone. One lawyer really should be handling all 3 jurisdictions if you want the best results. For 3 independant lawyers to coordinate all of this to your son's benefit is unlikely to happen (just based on logisitics). You shoud really do some homework as far as our skills and reputations go and then hire the best attorney that you can afford.
