Conspiracy to distribute

I have been charged with conspiracy with intent to distribute. However the cops found nothing on me they found a pack of cigs 10 feet away near a payphone with 2 bags of heroin inside. They found 2 hypodermic needles on my friend in a vehicle which i was not in and all 3 of us were charged. How can i be charged when nothing was found on me. Not even a dollar??And the other 2 defendabts were given a CWOF And im due for trial in 2 weeks.My attorney has filed motions to dismiss but the judge refuses. What else can my lawyer do so this case doesnt make it to trial???
