Legal Question in Criminal Law in Massachusetts

continued without finding

Would a cwof case from 21 years ago ever remain open? In court, the cwof was decreed, and a fine was issued and paid immediately. No return date to court or follow up was issued. Can it be assumed this case is closed?

I would never assume anything. However, a CWOF should automaticly be converted to Dismissed at the end of the term, assuming all conditions of the CWOF were met. If it were me, I would call the court to make sure that it had happened.

The CWOF should still be on your record and should show the case dimissed at the end of whatever period of time you were placed on probation. You can request a copy of your record from the Department of Probation or Criminal History records
