my husband is being charged with &E with the intent to comit a felony, larceny under$250, vandilism and civil rights violation. basically the are accusing him of spray painting a car and all these charges have come along with it. We have the clothes he was wearing that night...they say he has paint on him...he didn't. I make to much $ for him to get a court appt. lawyer but he goes to pre trail on tuesday and has no lawyer. he has no prior record. is it likly that he is going to go to jail. he was just in the wrong place at the wrong time:(

The charges you describe indicate there is more to this than just spray painting a car. To be honest, it sounds to me like he needs a lawyer. There is too much at stake not to have one.

With no record, it is likely that he could obtain some sort of probation pre-trial. However, if he did not have anything to do with the situation, he will need a trial. If he loses after a jury trial, given the charges, it is likely that he will get some jail time. It is difficult to say without having all of the details. He is charged with at least one felony.
