Legal Question in Criminal Law in Massachusetts
criminal assault
i am being accused of criminal assault by the father of my children's girlfriend during a verbal fight i was having with the father of children. I didn't speak to his girlfriend nor did I threaten anyone. The did not call the police or file a police report. They don't really have any evidence of an assault or even an attempted assault that I am aware of. I am a nurse and I am worried about this possibly ending up in on my CORI. I haven't been arrested or charged that I am aware of, but I have to appear in court. Is there cause for concern since I haven't been arrested just accused?

Re: criminal assault
Sadly, your concern is legitimate.
It would not get to court, but for someone's action.
Given your situation, you should consult and retain an attorney. You should do this way before your court appearance.

Re: criminal assault
It sounds like your court appearance will be a Clerk's Hearing: a more or less informal proceeding where your accuser and you both tell your stories to the Clerk Magistrate who then decides whether criminal charges will issue. If you win, the complaint will be dismissed and the case is over before it began. If you lose, a formal criminal case against you will ensue, and you will be summoned to court for an arraignment and other unpleasantries.
In which court do you need to appear?
