Legal Question in Criminal Law in Massachusetts

criminal harassment

The law for criminal harassment states that there must be at least 3 seperate occasions of harrassment. My case involves text messages that were sent. Some of the messages contained direct threats, others just said you f*cked w/ the wrong person, you'll regret it, ect. All of these messages were sent on the same day. Does each text message count as a seperate incident? There was one other text message sent about a week before the others, as well as a phone call.

You may have several different crimes. It sounds like some of the text messages may constitute a threat, or an assault.

If the texts are apart in time, they may well fit the prima facie case for this crime.

But without more, I cannot tell.

Contact your local police and/or go to your local district court and ask to speak to someone who can advise you whether you can bring a criminal complaint against the person sending you the messages. Obviously, bring to either place (the police or the district court) the phone containing the messages and any additional evidence you have of things you think might be threats.
