Criminal Responsibility of Person in presence of criminal behavior

If someone was shooting a paintgun out of a high window at friends below who were running around daring the shooter to hit them,and there was another person present watching tv aware of what was going on but not invovled, what if this shooting was reported to police and they came. Would the tv watcher be in any way culpable under the law?

The person watching does not appear to have any duty to report the event tot he police.

However, this person can be a witness as to the apparent wrongdoing.
