If you were convicted in a trial three years ago and find yourself in court today can your previous conviction be broght up in your new trial?

Absolutely.

The Court can look at any conviction and disposition, as can the DA and the probation department. Adverse information such as the one you described can be used against you in sentencing, and may be used against you should you elect to testify.

Prior convictions can also be considered on issues of bail, detention for dangerousness, and sentencing. It would only come up at trial if you testify.

What are the old charges? What's the new charge? Which courts?
