Legal Question in Criminal Law in Massachusetts

defendent has been in plymouth county jail for 10 months

he has had public defenders, about 3 now and they all have been replaced because of conflicts, the Judge is not happy. and his current public defender has had the case for 3-4 wks, still has not gone to see him or review his case. i have called him and he keeps saying tommorow or the next day. nothing is being done for this man age 20. he is charged w/ gun possetion and drug possetion. the apartment was not in his name and he wasn't in the apt when they raided it, there was other people there plus the owner of the apt. could you please help me find someone who could help or give advise?

This is very alarming. 10 months pre-trial is a ridiculously long stretch. I would need substantial additional information about this matter, namely is the case in District or Superior court, whether it's been set for trial, whether your friend is held on dangerousness or high bail, and whether there's been some form of bail review. It is unfortunate if not bad that those appointed have had or developed conflicts. It is also unfortunate that the present advocate has not contacted him. If you can contact me, I will give you the number to reach.

You have not said if the case is in District or Superior Court. You have not told me if he has had a bail hearing, and the results. You have not told me if he has filed a motion for a speedy trial.

The gun charge is serious. The drug possession charge depends on the nature of the drug and the amount found.

Whether he can legitimately charged I cannot tell from the facts provided. A person can be charged even if he is found in an apartment that is not his. The facts and the circumstances will show the link between him and the gun and drugs.
