Is it better to go to trail or have charges dismissed? If dismissed dose that mean you could of been guilty?

Re: dismissed charges

That is a fact specific question. If the DA is willing to dismiss the charges there is no risk of being found guilty. If you go to trial there is always the chance that you could be found guilty. Having said that, it is better to have a Not Guilty verdict than a dismissal. Not Guilty means that your case has been adjuducated and it has been determined that you are not guilty. You can not be tried twice for the same crime. When a charge is dismissed without prejudice, it can be brought back to life at a later date and no determination has been made. Dismissed with prejudice means the charge cannot be brought back later.
